Pay & Tax

Minimum wages, income tax brackets, employer contributions, and overtime rules β€” everything that affects how much you actually pay and what your employee takes home.

Minimum Wage Requirements
NCR β‚±15,116.25/mo

There is no single national minimum wage in the Philippines. Rates are set by region through the Regional Tripartite Wages and Productivity Boards (RTWPB). Remotify is incorporated in the National Capital Region (NCR).

NCR minimum wage: β‚±15,116.25 per month (β‚±610/day Γ— 24.794 days)
More detail

While the statutory minimum wage establishes the legal baseline, compensation for professional and knowledge-based roles is generally determined by prevailing market benchmarks to ensure competitiveness and talent retention.

Individual Income Tax β€” TRAIN Law (RA 10963)
0% – 35%

The Philippines uses a progressive tax structure on gross annual income under the TRAIN Act. Rates run from 0% for the lowest earners to 35% for income above β‚±8 million per year. Remotify handles BIR withholding, filing, and remittance.

Over β‚±8,000,000
β‚±2,202,500 + 35% over β‚±8,000,000
How withholding works

Tax is withheld every month on taxable income: gross salary minus the β‚±3,900 tax-free de minimis allowance and the employee’s SSS, PhilHealth and Pag-IBIG contributions, using the BIR TRAIN monthly withholding table.

Payroll Cost β€” Employer Statutory Contributions
~12.5% of salary

Employer overhead is approximately 12.5% of gross salary, composed of three mandatory government contributions. Remotify computes, files, and remits all of these on your behalf.

Leave Policy

Maternity, paternity, sick and special leave entitlements under Philippine law, and how Remotify administers them for you.

Maternity Leave
105 days

Pregnant employees are entitled to 105 days of maternity leave under Philippine law, regardless of SSS benefit eligibility. Qualified solo parents are entitled to an additional 15 days of paid leave, bringing the total entitlement to 120 days.

Employees may extend maternity leave by up to 30 additional days without pay, with appropriate notice.
How maternity pay is handled

Employees with sufficient SSS contributions during the applicable semester, and whose pregnancy has been properly reported to the SSS, may qualify for SSS maternity benefits. The employer advances 100% of the employee’s salary for the entire leave period, paid at least 30 days before the expected date of childbirth.

SSS reimburses the employer up to the applicable statutory limit (currently up to approximately β‚±70,000, subject to eligibility). Any salary differential required under Philippine law remains the employer’s responsibility.

As the Employer of Record, Remotify administers the process and advances the maternity pay. The full maternity salary is billed to the client in advance; once the SSS reimbursement is received, the reimbursed amount is credited back to the client.

Paternity Leave
7 working days

Qualified married male employees are entitled to seven (7) working days of paid paternity leave for the first four deliveries, including miscarriage, of their lawful spouse with whom they are cohabiting.

  • The employee must notify the employer of the pregnancy and expected date of delivery.
  • Leave may be taken before, during, or after the birth, up to seven working days in total.
  • The employee receives 100% of their regular salary during the leave.
Paternity leave is not reimbursed by SSS. The full salary cost is billed to the client.
Sick Leave
10 days typical

Standard practice often provides 10 days of sick leave per year. Any sick leave extending beyond two days requires a valid doctor’s certificate. Employees submit sick leave to Remotify through the Time Off feature.

When leave credits run out

Additional days beyond the employee’s leave credits are unpaid. Employees may qualify for reimbursement through the SSS Sickness Benefit, which ensures eligible employees receive a portion of their regular pay.

Termination

The Philippines is not an at-will jurisdiction. Here is what a compliant termination requires and how severance is protected.

Termination Requirements
Not at-will

Terminations must respect local labor law. The off-boarding process is always handled by Remotify in coordination with primary stakeholders to ensure full compliance, and may include ad-hoc fees and specific steps depending on the case. The employer must give written notice of the termination.

  • Just causes relate to employee conduct or performance, such as serious misconduct, willful disobedience, gross and habitual neglect of duties, or fraud.
  • Authorized causes relate to business necessity, such as redundancy, retrenchment to prevent losses, or closure of operations.
  • Non-regularization: failing clearly communicated performance standards, or receiving a Final Written Warning during probation, can warrant non-regularization.
Notice Period
30 days

The minimum notice period is usually 30 days.

Severance for Employees
0.5 – 1 month / year

Severance pay depends on the cause of termination and ranges from 0.5 months to 1 month’s wages for each year of employment.

Cause
Severance (whichever is higher)
Redundancy
1 month’s pay, or 1 month per year of service
Retrenchment, closure or disease
1 month’s pay, or 0.5 month per year of service
Remotify applies a Severance Accrual to every Philippine employment agreement. If your employee resigns or is not entitled to severance, all unused amounts are returned to you.
